Apply for a residence permit as a family member to a person in Denmark displaced from Ukraine

You would like to apply for a residence permit as a close family member to a person in Denmark, who has been granted a residence permit as a displaced from Ukraine. You can be granted a temporary residence permit under the law on temporary residence permits for displaced persons from Ukraine (the Special Act).

Who can be granted a residence permit?

If certain requirements are met, you can be granted a residence permit as a close family member to a person in Denmark, who has been granted a residence permit under section 1 of the Special Act. You can apply concurrently with the family member applying for a residence permit under section 1 of the Special Act.

If you are staying in Denmark, and you are either a Ukrainian citizen or a recognized refugee in Ukraine, you should not apply as a family member. In this case you can be granted a residence permit under section 1 of the Special Act yourself, if certain requirements are met.

EU citizens

If you are a citizen in another EU country and you for example have a job in Denmark, you can also get EU residency document. There is no expiry date on the residency document, which means that you have the right to stay in Denmark, as long as you meet the requirements of e.g. working in Denmark. You can apply for a EU residency document at the Danish Agency for International Recruitment and Integration (SIRI).

What are the requirements?

You can obtain a residence permit under the Special Act section 2, if you are afamily member of a person who has been granted a residence permit under one of the above-mentioned conditions in section 1.

You are a family member of the person who has been granted a residence permit under section 1, if you are:

  • cohabiting spouse,
  • cohabiting partner,
  • unmarried child under the age of 18,
  • close family member who has resided with the person and who were supported by the person, or
  • another close family member who is residing and has a family life worth of protection with the person who has been granted a residence permit under the conditions in section 1 (e.g. parent to a child under 18 years).  

It is a requirement that the family life consisted on 24 February 2022.

You can also be granted a residence permit after section 2 of the Special Act as an unmarried child under the age of 18 if your parent has residence permit after section 2 as a spouse or partner to a person with a residence permit after section 1.

An application for a residence permit under section 2 may be submitted in Denmark or outside the country.

If you would like to make changes to an application after you have submitted it, you need to contact the Immigration Service. You do not need to submit a new application. Contact the Immigration Service

If you are in Denmark, you have to book an appointment to submit your application and have your biometrics recorded and be identity checked at the Immigration Service's Citizen Service. You book an appointment online at this page.  

If you are abroad, you can submit the application to a Danish diplomatic mission (embassy), where you will also have to have your biometrics recorded and be identity checked.

If you have children, applying concurrently with you it is very important that the children are with you, when you shop up at Citizen Service, because an identity check must be made on the children. Therefore, you must bring the children’s passports or other identity documents.
