Who can be granted a residence permit?

If certain requirements are met, you can be granted a residence permit under the Special Act section 1, if you are staying in Denmark, and you are either a Ukrainian citizen or a recognized refugee in Ukraine. 

You can also be granted a residence permit if you are a close family member of a person, who has been granted residence permit under the Special Act and you meet the requirements. Read more about residence permit under the Special Act section 2

What are the requirements?

You can be granted a temporary residence permit under the Special Act section 1 if you:

  • are an Ukrainian citizen and have left Ukraine on 1 February 2022 or later, where you had residence on 1 February 2022 or later,
  • on 24 February 2022 were a recognized refugee in Ukraine and have left Ukraine on 1 February 2022 or later, or
  • are an Ukrainian citizen or on 24 February 2022 were recognized as a refugee in Ukraine have resided or have had another residence permit in Denmark on 24 February 2022.

You must be in Denmark in order to apply for a residence permit under section 1. 

The Danish Immigration Service makes decisions on residence permits under the Special Act.

If you have a citizenship in another country than Ukraine or have been granted a residence permit in another country than Ukraine, your application for residence permit in Denmark can be rejected. If you are a refugee in Ukraine, your residence can however only be rejected if you have been granted citizenship or residence permit in another country than Ukraine and your home country. 

If you have a spouse/cohabiting partner, a child over the age of 18 or another close family member who is also residing in Denmark and who is also either a Ukrainian citizen or recognized as a refugee in Ukraine, they can also be granted a residence permit under section 1.

If you have a close family member who is not a Ukrainian citizen or recognized as a refugee himself/herself, he/she can be granted a residence permit under section 2. When must you have been in Ukraine in order to get a residence permit?

If you have been in Denmark on 24 February 2022 the requirement of having stayed in this country on that date is met, and you will be able to obtain a residence permit on that basis if the other requirements are also met.

If you have stayed elsewhere than Denmark and Ukraine, but have returned to Ukraine and then left at a later date than 24 February 2022, you will meet the requirement of having departed from Ukraine on 24 February 2022 or later and you will be able to obtain a residence permit on that basis if the other requirements are also met.

If, however, you have not returned to Ukraine after having stayed elsewhere than Denmark and thus do not meet the requirement of having left Ukraine on 24 February 2022 or later, you will normally not be able to obtain a residence permit under section 1 of the Special Act.

If you do not meet the conditions in section 1, it is possible to obtain a residence permit under the rule in section 2 as accompanying family, if you have a close family member in Denmark who has a residence permit under section 1.

Which type of residence permit will you be granted?

You will be granted a residence permit with a view to temporary residence in Denmark that is valid until 17 March 2026.

You are entitle to work in Denmark, when you have been granted a residence permit.

The information below explains how to apply for a residence permit if you are a person in Denmark displaced from Ukraine.

You must fill in an application form and enclose documentation. It is a good idea to gather the documentation before you start.

You, who apply for a residence permit, need to fill in the application. If you have children under 18 years who also wish to apply, you must inform this in your application. You do not need to make separate applications for the children.

The application form includes detailed instructions for how to fill it in and which types of documentation you can attach.

If you would like to make changes to an application after you have submitted it, you need to contact the Immigration Service. You do not need to submit a new application. Contact the Immigration Service

When you have submitted the application, you have the right to stay in Denmark while the case is processed.

It is normally required that you have a valid passport. It is therefore mandatory to enter passport information in SL1 online. If you do not have a valid passport or other travel identification, but still wish to apply, you can use the paper-based application form. In the online form, you can also enter arbitrary characters under passport information (e.g. passport number 111) and state this under comments at the end of the application.

When you have fulfilled the application you must book an appointment to have biometric features recorded and be identity checked at the Danish Immigration Service' Citizen Service. You can book an appointment on this page

The deadline for having biometric features recorded is 14 days from the time you submitted your application.

When you show up at the Immigration Service’s Citizen Service you must bring your receipt for the digital application and have your biometrics recorded. If you wish to use the paper based form you must bring the fulfilled application form, when you show up at Citizen Service to have your biometrics recorded.

Children must also show up

 If you have children, applying concurrently with you it is very important that the children are with you, when you show up at the Citizen Service, because an identity check must be made on the children. Therefore, you must bring the children’s passports or other identity documents.

Children under the age of 18 who are living with the custody holder in Denmark do not normally need a residence card. A child can, however, request to be issued a residence card. If the children request a residence card, the children must also have their biometric features recorded. It can be useful for children to have a residence card when re-entering Denmark after traveling abroad. If the children have a residence card, they do not need to apply for a re-entry permit (TBT) in connection with trips abroad.

If you have previously applied for asylum

If you have applied for asylum in Denmark and have received an asylum card, or if you were registered at Centre Sandholm and have received an accommodation card, you do not need to have biometric features recorded again. Therefore, you do not have to book an appointment at the Citizen Service. You only have to submit a digital application.
