In certain cases, concerning first-time applications, you can have your case at SIRI resumed and have your fee refunded

If you have been refused a residence permit based on a first-time application, because you have submitted the application too early, SIRI cannot identify your case automatically. You must therefore make a request yourself, in order to have your case resumed.

If you have been refused a residence permit based on a first-time application, because you have submitted the application earlier than 6 months before you were supposed to begin your residence in Denmark, you might be able to have your case resumed and have your fee refunded. This does not apply to applications concerning extensions.

Remember to inform us of your personal ID or your case number, the date of when the decision was made regarding your case, as well as to attach a receipt for the payment of the fee, if relevant.

If the application is more than 3 years old, you cannot have your fee refunded

As a rule, you cannot have your fee refunded if your application is more than 3 years old. This is because any claims concerning refunds of fees are covered by the general rules of the Statue of Limitations. The 3-year deadline in question does not apply if the Statue of Limitations has been interrupted or suspended – for example if you have previously approached SIRI about your case, or if you have just recently been made aware of the fact that the decision concerning your case might be incorrect.

SIRI has changed its practice

On 18 June 2025, the Immigration Appeals Board established that SIRI does not have the legal basis to refuse cases concerning first-time applications for residence and work permits, if the decision is solely based on the fact that the application was submitted earlier than 6 months prior to the planned residence in Denmark. Due to this decision, SIRI will resume refused first-time applications.

Therefore, on 14 July 2025, SIRI has changed its practice. This means that SIRI no longer refuses first-time applications if they have been submitted too early.
