Adjustment of SIRI’s practice when processing applications for extensions in the area of work

In order to be granted a residence and work permit based on salaried work in Denmark, it is a requirement that the foreign national’s employment corresponds to Danish standards for salary and terms of employment.

Regarding applications for extension in the area of work, SIRI’s practice until now has been to to assess whether the foreign national has received a salary that corresponds to the employment contract on the basis of which the residence and work permit was granted.

From now on, SIRI will assess whether the foreign national’s salary corresponds to Danish standards when the foreign national applies for an extension of his or her residence and work permit under the following schemes:

  • The positive list for people with a higher education
  • The positive list for skilled work
  • The pay limit scheme
  • The fast track scheme’s pay limit track and researcher track
  • Researchers
  • Special individual qualifications
  • Herdsmen and farm managers
  • Labour market attachment
  • Internships
  • Work permits, incl. employment for adaptation and training purposes, for people on authorisation stay
  • Accompanying family members applying for extension of a work permit based on work in the same company as the sponsor
  • Work permits for the Faroe Islands and Greenland granted for work with a specific employer

The adjusted practice for processing applications for extension will take effect for applications submitted from 1 March 2022 onwards.

SIRI’s assessment of whether the salary corresponds to Danish standards will take place according to the same principles as in first time applications. If the pay is below the usual level, an extension of the residence and work permit will not be granted.
