Apply for a residence permit as a person displaced from Ukraine on the Faroe Islands

The Application of the Special Act on temporary residence permit for displaced persons from Ukraine on the Faroe Islands (the Special Act) was finally adopted by Lagtinget on 8 April 2022 and in force by 10 April 2022.

You can be granted a temporary residence permit under the Special Act section 1 if you:

• are an Ukrainian citizen and have left Ukraine on 24 February 2022 or later, where you have resided when you departet,
• on 24 February 2022 were a recognized refugee in Ukraine and have left Ukraine on 24 February 2022 or later, or
• are an Ukrainian citizen or on 24 February 2022 were recognized as a refugee in Ukraine have resided or have had another residence permit on the Faroe Islands on 24 February 2022.

If you have a citizenship in another country than Ukraine or have been granted a residence permit in another country than Ukraine, your application for residence permit on the Faroe Islands can be rejected. If you are a refugee in Ukraine, your residence can however only be rejected if you have been granted citizenship or residence permit in another country than Ukraine and your home country. 

You can obtain a residence permit under the Special Act section 2, if you are afamily member of a person who has been granted a residence permit under one of the above-mentioned conditions in section 1.

You are a family member of the person who has been granted a residence permit under section 1, if you are:

• cohabiting spouse,
• cohabiting partner,
• unmarried child under the age of 18, or
• another close family member who has resided with the person and who were supported by the person.

It is a requirement that the family life consisted on 24 February 2022.

You can also be granted a residence permit after section 2 of the Special Act as an unmarried child under the age of 18 if your parent has residence permit after section 2 as a spouse or partner to a person with a residence permit after section 1.You must be on the Faroe Islands in order to apply for a residence permit under section 1. An application for a residence permit under section 2 may be submitted on the Faroe Islands or outside the country.

The Danish Immigration Service makes decisions on residence permits under the Special Act.

If you have been on the Faroe Islands on 24 February 2022 the requirement of having stayed in this country on that date is met, and you will be able to obtain a residence permit on that basis if the other requirements are also met.

If you have stayed elsewhere than the Faroe Islands and Ukraine, but have returned to Ukraine and then left at a later date than 24 February 2022, you will meet the requirement of having departed from Ukraine on 24 February 2022 or later and you will be able to obtain a residence permit on that basis if the other requirements are also met.

If, however, you have not returned to Ukraine after having stayed elsewhere than the Faroe Islands and thus do not meet the requirement of having left Ukraine on 24 February 2022 or later, you will normally not be able to obtain a residence permit under section 1 of the Special Act.

If you do not meet the conditions in section 1, it is possible to obtain a residence permit under the rule in section 2 as accompanying family, if you have a close family member on the Faroe Islands who has a residence permit under section 1.

If you want to apply as a Ukrainian or recognized refugee from Ukraine who is on the Faroe Islands (the Special Act section 1)

How to apply:

1. Print the form and fill in by hand, or fill in on the computer (Word format only) and print the form.
2. Sign the form by hand.
3. Make copies of your identity documents and other relevant documents.
4. Submit the application and have your biometrics recorded. The application must be submitted at the police on the Faroe Islands. If you submit the application at the police in Tórshavn you must have your biometric features recorded when you submit the application. If you submit the application at another police station on the Faroe Islands you must book an appointment to have biometric features recorded at the police in Tórshavn. 

NOTE: If you have children, applying concurrently with you it is very important that the children are with you, when you shop up at the police on the Faroe Islands, and that you bring the children’s passports or other identity documents. 

When you have submitted the application, you have the right to stay on the Faroe Islands while the case is processed.

If you want to apply as a family member of a Ukrainian or family member of a recognized refugee from Ukraine, who is on the Faroe Islands (the Special Act section 2)

You can use the application form FO/SL2. You only have to use FO/SL2 as a family member if you are not on the Faroe Islands or if you are not a Ukrainian citizen. If you are a Ukrainian citizen and you are on the Faroe Islands, you must apply via FO/SL1 even though you are a family member to another Ukrainian citizen on the Faroe Islands.

If you are on the Faroe Islands the application must be submitted at the police on the Faroe Islands. If you submit the application at the police in Tórshavn you must have your biometric features recorded when you submit the application. If you are abroad, you can submit the application to a Danish diplomatic mission (embassy), where you will also have to have your biometrics recorded.

While your application for a residence permit under the Special Act is being processed, you cannot take up a job on the Faroe Islands. You only have the right to work on the Faroe Islands once you have received a residence permit from the Immigration Service.

You may find a job and get an employment contract while your case is being processed, but you cannot begin work until you have a residence permit.

If you still have another valid residence permit on the Faroe Islands, or if the visa-free stay or visa you traveled into the country on has not yet expired, you can travel freely in and out of the Faroe Islands, and also to Ukraine.

If you have no other basis of residence on the Faroe Islands than the residence that your ongoing case for a residence permit under the Special Act gives you, you must have a re-entry permit to be able to enter the Faroe Islands again after traveling out of the country.

 The application for a re-entry permit must be submitted to the police on the Faroe Islands.

Please note that if we lack information in connection to the assessment of your application for residence permit, we will try and contact you by phone. If we cannot reach you, or you are unable to send the missing information to us – e.g. because you have departed during the case processing – we will not be able to decide on the case and it will then wait until we can assess as to whether the requirements for a residence permit are met.
